Live Trading Risk Acknowledgment

Where this appears in the product: shown in-app the first time a user attempts to enable live trading (the switch from paper to a real-money account), BEFORE ALLOW_LIVE_TRADING can be set. Each numbered item requires its own affirmative check; the final confirmation shows the configured account's masked suffix and requires typing its last 4 characters. A timestamped record (masked account suffix, a one-way cryptographic hash of the account binding, date, version of this text) is stored on the user's machine in the Software's data folder — the full account number is never stored in the record, and nothing is sent to the server; the record is checked at every broker connection against the connected account. Re-acknowledgment is required when this text changes.

Before you enable live trading, confirm that you understand and accept each of the following:

1. I can lose money — including more than I expect. Nexus Trader trades with real orders on my own Interactive Brokers account, using margin (up to 1.5× gross leverage). Losses are real, can exceed simulated historical losses, and in adverse conditions a position can lose more than the amount I mentally allocated to it. I can afford the losses this account may take.

2. The performance numbers I have seen are simulations, not promises. The published backtest results (+622% over five simulated years; +1,349% over ten) are Simulated. They do not represent actual trading, do not capture every cost or market condition, and are not a forecast of my account. Past performance, real or simulated, is not indicative of future results.

3. Most trades lose. That is the design, not a defect. Roughly 4 out of 5 trades lose a small amount. Returns, if any, depend on a small number of large winners. I will not judge the system on any individual trade.

4. Losing streaks last for months. I have seen the numbers. Across the published simulations the longest run without a single winning trade was 42 consecutive trades — about three months (5-year run; the 10-year run's longest was 41). Streaks of 22 or more trades without a win occurred roughly once every ten months. I accept that months of uninterrupted small losses are within normal operation, and I understand that switching the system off mid-streak is how the losses are kept and the recoveries are missed — a decision that is mine alone to make and mine alone to bear.

5. Drawdowns are deep AND long. The simulated maximum drawdown was −23% (5-year) to −27% (10-year), the longest stretch below a prior equity peak lasted about 18 months, and one simulated calendar year was negative. Future drawdowns can be deeper and longer than anything in the simulations.

6. Nobody is managing my money, and nobody is advising me. Nexus Trader is software I run, on my machine, on my account. Nexus does not hold, access, or control my funds; is not a broker, dealer, portfolio manager, or investment adviser; and provides no personalized advice. (The software itself monitors and manages the positions in my account — that is its function; no human at Nexus supervises my trading.) The decision to run this software, with real money, is entirely mine.

7. I am responsible for the operating requirements. Live trading requires real-time IBKR market data subscriptions (the US Securities Snapshot and Futures Value Bundle plus the Network A/B/C streaming feeds), a PC that stays on and awake 04:00–20:00 ET on trading days, TWS running with API access, and a margin account meeting the published minimum. If these are not met the software will block entries or fail to manage positions as designed, and outcomes from my failure to meet them are mine.

8. Software fails; markets misbehave; I retain a duty to supervise my own account. Bugs, outages, data errors, broker rejections, connectivity loss, or my PC sleeping can cause missed entries, missed exits, unprotected positions, or erroneous orders. Protective stops can fill at worse prices than their trigger, or in rare conditions not at all. I remain the account holder of record with full authority and responsibility over every position, and I can flatten the account at the broker at any time without the software's cooperation.

9. Responsibility and release. To the maximum extent permitted by applicable law, I accept sole responsibility for all trading results in my account, and I release Nexus, its directors, employees and contractors from liability for trading losses, lost profits, missed trades, erroneous orders, data errors, service interruptions, or margin calls arising from my use of the software, except where such liability cannot lawfully be excluded.

Final confirmation: I have read each item above and checked it individually. I am the holder of the IBKR account whose masked suffix is shown (********[last 4]) and I am enabling LIVE trading on it at my own risk.
